Ohio Disability Discrimination
The Americans with Disabilities Act (“ADA”) prohibits discrimination against employees with disabilities by state and local governmental entities and by private employers with fifteen (15) or more employees. The ADA was amended in 2008 to make it easier for an employee seeking protection under the ADA to establish that he or she has a disability. American with Disabilities Act Amendments Act of 2008 (“ADAAA”), 42 U.S.C. § 12102. The Equal Employment Opportunity Commission (“EEOC”) enforces the provisions of the ADA and the ADAAA.
Further, Ohio law prohibits discrimination by employers with four (4) or more employees. Ohio Revised Code Section 4112.02 provides that it is unlawful for any employer to refuse to hire or otherwise to discriminate against that person because of the race, color, religion, sex, military status, national origin, disability, age, or ancestry of any person, to discharge without just cause, "Disability" means a physical or mental impairment that substantially limits one or more major life activities, including the functions of caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working; a record of a physical or mental impairment, or being regarded as having a physical or mental impairment. R.C. Chapter 4112.
